Article II. TOWING COMPANY |
Division 2. TOW TRUCK SERVICE PERMITS |
§ 90-58. Application.
Any company desiring to perform nonconsent tows within the city shall make application to the chief of police for a tow truck service permit, which application shall be submitted on a form provided by the chief of police, and signed and notarized. Each application shall contain the following information:
(1)
A statement that the applicant has attained the age of 18 years.
(2)
For each auto wrecker company for which a permit is sought, the applicant shall provide the following information:
a.
Year and make;
b.
Vehicle identification number;
c.
Current state license plate number;
d.
Name, address, primary e-mail address and telephone number of the tow truck's owner; and the name, address, primary e-mail address and operator's license number for each person who will be an operator of each such tow truck;
e.
A certificate of insurance evidencing the type and amounts of coverage as required and specified by section 90-67;
f.
A signed statement agreeing to comply with the tow truck service and vehicle storage fees established by the city;
g.
A signed statement disclosing what, if any, pecuniary interest the tow truck operator may have in any person or entity that repairs or sells motor vehicles within the city;
h.
A true and correct copy of the current tow truck vehicle registration for each tow truck;
i.
If the applicant is a corporation, a certificate of good standing issued by the Secretary of State of the State of Texas;
j.
A statement of the fees the applicant proposes to charge for nonconsent tows, including fees, if any, for special towing services or equipment; and
k.
A copy of a valid license issued pursuant to the Texas Vehicle Storage Facility Act, V.T.C.A., Occupations Code § 2303.001 et seq., for the storage facility the applicant proposes to use.
(3)
If an applicant is a corporation, limited liability corporation, limited liability partnership, partnership, or any other entity created within the state or any other state, or proposes to operate under a name other than that of the applicant owner, the names and addresses of the corporate officers, partners, or the true business owner. A tow truck service permit issued to one such entity is not transferable to another without the written approval of the chief of police.
